1. Introduction: These terms and conditions (the "Terms") govern the purchase of custom orders and special marine Equipment from OBMETRA. By placing an order for the Equipment, you agree to be bound by these Terms.
2. Custom Order and Special Equipment: The Equipment is custom-made and specially designed to meet your requirements. The Equipment is not a standard product and is not subject to cancellation or return.
3. Payment: Payment for the Equipment must be made in full before the production of the Equipment begins. Payment is non-refundable and non-cancellable.
4. Delivery: Delivery of the Equipment will be made to the address specified by you at the time of ordering. Delivery times are estimates only and cannot be guaranteed. We will not be liable for any delivery delays.
5. Product Description and Availability: We have taken reasonable care to ensure that the descriptions and specifications of the Equipment are accurate. However, we cannot accept any responsibility for any errors or omissions. The Equipment is subject to availability.
6. Warranty: The Equipment comes with a year manufacturer's warranty. This warranty does not cover any damage caused by normal wear and tear, accidents, or misuse of the Equipment.
7. Limitation of Liability: To the fullest extent permitted by law, we will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with the use of the Equipment.
8. Governing Law: These Terms shall be governed by and construed under the laws of These Terms, and the use of the Services will be governed by laws of the United Arab Emirates, without giving effect to any principles of conflicts of law. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the United Arab Emirates.
